I understand that there is a possibility that it may not be able to be sold due to the ongoing lawsuit DJI has brought.

Until that announcement was made, I was ready to pre-order but now I'm concerned that if I do, I will be unable to get the machine. If I wait, however, and nothing comes of the lawsuit then I miss out on some great pre-order items.

It's a lot of money for me to have held up in a gamble so is there any assurances or anything the public could know that absolutely guarantees shipment when available?

You will miss out on the wizard, but honestly at this point it may be best to wait for two reasons:
1) The Lawsuit
2) The real sense obstacle avoidance will become available in May, maybe

lawsuit wont make a jot of difference, they are shipping to retailers already and facebook has forums showing the boxes and contents, so they will be shipping anytime now
