I stress, I DO NOT ADVOCATE THIS TYPE OF THOUGHT, but Ironically, the message the FAA may be sending is: Don't apply for a drone filming permit (COA) because if it's not granted, you've just tattled on yourself.

This 'Close Proximity' rule is too open ended! Whats close? 10ft? 25ft? 50ft? What if the people are on private property and were notified of drone filming prior to stepping onto that property? God forbid you go to an RC show and all the pilots get written up because there were spectators watching...

The faa love to find ppl pilots cause the have something to lose and be taken away. It's safer if you don't. Fly safe.
