40. How should I fly my RPAS recreationally?
Users of remotely piloted aircraft (RPA) intended for recreational use shall refrain from carrying out actions that may jeopardize the safety, regularity and continuity of aeronautical operations and shall operate such aircraft under the following conditions:
- By day, in meteorological conditions of visual flight and giving priority to the other categories of aircraft, unless the RPA weighs 2 kg or less and is flown to a maximum height of 50 meters on the ground.
- Within the visual range of the pilot no longer than 120 m in height on the ground or on the highest obstacle within 150 m of the aircraft.
- Maintaining a suitable distance to obstacles and without risking the safety of people and goods on the surface.
- No overcrowding of buildings in cities, towns or inhabited places or meetings of people outdoors should be avoided if the RPA weighs more than 250 g. For RPA of less than or equal to 250 g, the height of flight on the ground must not exceed 20 meters in such situations.
- Out of controlled airspace, FIZ flight information area or ATZ aerodrome transit area, except those operations that are carried out from RPAS infrastructures, under the conditions established in the coordination procedures agreed by the responsible of said infrastructures with the air traffic service provider.

- 8 km from the reference point and
- 8 km from the runway axes and its extension up to 6 km from the threshold of the same,
this distance can be reduced if an agreed coordination procedure is established with the airport manager or responsible for the infrastructure and the RPA is flown according to what is established in said procedure.
- At night, with airplanes of less than 2 kg of MTOM up to a maximum height on the ground of 50m.
- When using first-person vision devices (FPV), the operation must be performed within the visual range, without the help of these devices, by observers who remain in permanent contact with the pilot.
The dissemination of images of people or private spaces needs authorization from them, having to comply with the regulation on Data Protection, the Law of the Right to Honor, personal and family privacy and the image itself. Likewise, restrictions on taking aerial images must be respected.

41. Can I fly the RPAS in my city / park / neighborhood in a recreational way?
RPA of any weight can be flown in the following conditions:
- Out of controlled airspace, FIZ and ATZ.
- More than 8 km from the reference point of any airport or aerodrome and more than 8 km from the axes of its runways and its extension up to 6 km from the threshold of the same.
- Without flying over agglomerations of buildings or meetings of people.
- Maintaining a suitable distance to obstacles and without risking the safety of people and goods.
- Giving priority to the other categories of aircraft.
- By day and in meteorological conditions of visual flight.
- Within the visual range of the pilot.
- Up to 120 meters high on the ground or on the highest obstacle located within a radius of 150 m from the RPA.
With RPA up to 250 g in weight, you can fly over agglomerations of buildings and people's meetings up to a maximum height of 20 meters, keeping the rest of the previous conditions.
Do not forget that you are responsible for the damage caused by your RPA, that's why civil liability insurance is recommended.
42. Can I fly over people on the beach, a concert, a party, a wedding, a communion, etc., in a recreational way?
You can not fly over outdoor people meetings or crowds of buildings in inhabited places if your RPA weighs more than 250 grams.
If your RPA weighs 250 grams or less, you can fly in environments of buildings or meetings of people outdoors as long as they do not exceed 20 meters in height, do not cause inconvenience to other people and respect the other conditions mentioned in response 40.
It is advisable to have a civil liability insurance.
In the case of pretending to make recordings with RPAS, the regulation of Data Protection, the civil protection law of the right to honor, the personal and family privacy and the image itself, the restrictions for taking aerial images should be taken into account. and have permission to publicly disseminate those images.

43. How and where can I report an alleged illegal flight? What procedures should I follow to report illegal flights? Should I notify the police? Can I communicate directly to the AESA by email?
AESA studies all the complaints received and recommends that the citizen denounce those cases in which he believes that the rule is being violated. The denunciations can be presented before the Security Forces and Bodies, as well as in the own State Agency of Aerial Security.
To file complaints with AESA, these must be made in writing, identifying the complainant with their name and national identity document, providing the largest possible number of data in relation to the reported event:
- Data of the physical or legal person denounced, with an express indication of an address for the purposes of postal notification
- Date of the events
- Indication of the area overflown and a brief description of the conditions in which the flight has been developed (day, night, overflight of people, controlled airspace, etc.)
- Data of the aircraft (type, number of the identification plate, etc.)
- Data of the pilot in command
- Any other documentation that can clarify the facts
